For the purposes of applicable data protection law, Silver Agency Limited is the data controller where we determine how and why your personal information is processed.

Where we process personal information solely on behalf of one of our clients, we will normally act as a data processor and the relevant client will be responsible for determining how that information is used.

This policy applies to personal information we process in connection with our website, our marketing and business development activities, our relationships with clients, prospects, suppliers and other business contacts, and recruitment.

Our processing of personal information is governed by applicable data protection legislation, including the UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003, as amended, and the Data (Use and Access) Act 2025.

What information we collect

The personal information we collect depends on how you interact with Silver. It may include:

  • information you provide when you contact us, submit an enquiry, register for content or communicate with our team;
  • information relating to our relationship with you or the organisation you represent, including correspondence, meeting information and commercial records;
  • marketing preferences and information about your engagement with Silver communications;
  • technical and usage information generated when you visit our website, such as IP address, browser and device information, referring pages and interactions with our website;
  • information obtained from publicly available professional sources, referrals, clients and appropriate third-party business information or data-enrichment services; and
  • information provided as part of a recruitment process.

We aim to collect only the personal information that is relevant and necessary for the purpose for which it is being used.

How we collect personal information

We may collect personal information:

  • directly from you, for example when you contact us, complete a form, attend an event, communicate with our team or apply for a role;
  • automatically, when you use our website or interact with our digital communications;
  • from the organisation you work for, our clients, partners or other business contacts;
  • from publicly available sources, including professional and company information; and
  • from third-party platforms and data providers, where appropriate, including where we undertake permitted data-enrichment activities.

Where we obtain personal information from other sources, we process it in accordance with applicable data protection and direct-marketing law.

How and why we use your information

We only process personal information where we have a lawful basis for doing so.

Where we rely on legitimate interests, we consider the purpose of the processing, whether it is necessary and the potential impact on the rights and interests of the individual concerned.

Where we rely on consent, you can withdraw that consent at any time.

Marketing and business development

As a B2B marketing agency, Silver may process professional contact information for business development and marketing purposes.

This may include information that you provide directly to us as well as relevant professional information obtained from publicly available sources, referrals or appropriate third-party business information and data-enrichment services.

Where we use personal information for direct marketing, we do so in accordance with applicable data protection and electronic communications legislation.

Depending on the circumstances, we may rely on our legitimate interests in promoting and developing Silver’s services or on consent where consent is required.

You have the right to object to the use of your personal information for direct marketing at any time.

Every electronic marketing communication we send will provide an appropriate way to opt out where required. You can also contact us directly to ask us to stop using your information for marketing purposes.

Where you opt out, we may retain limited information on a suppression list so that we can respect your preference in the future.

Client data

As part of providing marketing services, Silver may process personal information owned or controlled by our clients.

Where we process that information solely on a client’s behalf and in accordance with their instructions, the client will normally be the data controller and Silver will act as its data processor.

Our processing in these circumstances is governed by our agreement with the client, applicable data protection legislation and Silver’s internal data protection and security requirements.

Where relevant, you should refer to the privacy notice of the organisation that originally collected your personal information for further information about how it is used.

International transfers

Silver works internationally and uses technology and service providers that may process information outside the United Kingdom.

Where personal information is transferred outside the UK, we take appropriate steps to ensure that the information continues to receive an appropriate level of protection.

Depending on the destination and circumstances, these protections may include:

You can contact our Data Protection Lead if you would like further information about the safeguards applicable to your personal information.

How long we keep personal information

We do not retain personal information for longer than is necessary for the purposes for which it was collected and processed.

Retention periods vary according to the type of information, the reason we hold it, our legal and contractual obligations and whether the information remains necessary and relevant.

Under our current Data Retention Policy:

  • client-owned marketing contact data processed by Silver is normally retained for up to one year;
  • Silver’s own marketing contact data is retained only while it remains necessary and relevant for the purpose for which it is held;
  • recruitment information is normally retained for 30 days following the conclusion of the relevant recruitment activity; and
  • other business records are retained in accordance with the relevant purpose and applicable legal, contractual, accounting and regulatory requirements.

Information may be deleted sooner where appropriate, including where a valid request for erasure is received.

When information reaches the end of its applicable retention period, it is securely deleted, destroyed or otherwise disposed of in accordance with our internal retention and security procedures.

  • withdraw consent at any time where processing is based on consent; and
  • exercise rights relating to certain automated decision-making and profiling.

These rights are subject to conditions and exemptions under applicable data protection legislation and will not apply in every circumstance.

We will consider requests without undue delay and will normally respond within one month, subject to any permitted extension.

You will not normally be required to pay a fee to exercise your rights.

Data protection complaints

If you have concerns about how Silver has collected or used your personal information, please contact us so that we can investigate.
